• Releasees: This release of liability is given to each of TLV Balanced Life SRL , Sally Nilsson, Eric Kolesar and anyone appointed by them to assist with or in connection with the Horse Activities (together the “Facilitator”).  
• Releasor(s) & Horse Activities: The individual named below (referred to as “I” or “me” or “Participant”) desires to participate in or observe horse-related activities provided by/arranged by the Facilitator, including without limitation: being around, in the vicinity of and/or interacting with on-site animals, including horses, dogs, cats and related equipment; and horse-back riding and other horse-related activities, including ground-work and any kind of interaction with horses and related equipment; and any equine facilitated learning experiences or similar (the “Horse Activities”).

Acknowledgements and Assumptions of Risks: 

I am aware and understand that there are risks inherent in the Horse Activities that I may participate in and that they could result in serious injury and/or death and/or property loss or damage. I acknowledge that any injuries that I sustain may be compounded by negligent emergency response or rescue operations of the Facilitator.

I acknowledge that I am voluntarily participating in the Horse Activities with knowledge of the danger involved.  Further, there may be other risks not known to me or reasonably foreseeable at this time.  I voluntarily and freely choose to assume these risks.

I understand and will abide by all the safety guidelines provided to me.

In particular I am aware and acknowledge that:

• Horses and other animals have natural instincts and may react or move unpredictably which could cause harm;

• Horse Activities take place in natural settings and in potentially unpredictable or dangerous conditions and, in particular, the local environment and pastures of Costa Rica contain many species of potentially harmful plants, reptiles and insects;

• Horse Activities may have a psychological, emotional or mental impact. The Facilitator is not a mental health professional (unless otherwise indicated) and experiences are not therapy or replacement for treatment. If you have a history of mental health concerns and are currently in a treatment process with a licensed clinician, we advise you to discuss the benefits and potential risks of a triggering event with your therapist before engaging in Horse Activities. By signing below I acknowledge that I have made an informed decision to proceed;

• I understand that wearing a helmet significantly reduces my risk of serious injury while riding a horse;

• I am solely responsible for my own property at all times;

• I am of sound mind and I am physically and emotionally able to participate in the Horse Activities.

• Consent, Waiver and Release: Due to the potential benefits of the Horse Activities, I hereby expressly waive and release any and all claims, now known or hereafter known in any jurisdiction throughout the world, against the Facilitator (collectively, “Releasee“), on account of injury (including non-physical injury), death or property loss or damage to me or anyone accompanying me arising out of or attributable to the Horse Activities, whether arising out of the negligence of any Releasee or otherwise. I covenant not to make or bring any such claim against the Facilitator or any other Releasee, and forever release and discharge the Facilitator and all other Releasees from liability under such claims. I agree to the Facilitator making heath care decisions for me if I or the undersigned Parent/Guardian is unavailable to obtain such information or to make such decisions. Should the Facilitator or anyone acting on the behalf of the Facilitator be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
• Other: If any portion of this Release and Assumption is held invalid, the remainder shall not be affected and shall continue in full legal force and effect. The terms of this Release and Assumption shall continue from this date forever. This Release and Assumption is governed by the laws of Costa Rica without giving effect to any choice or conflict of law provision or rule. Any claim or cause of action arising under this Agreement may be brought only in the courts of Costa Rica.
  
• Media/Data Release: I hereby give permission for images captured during Horse Activities through audio, video, photo and digital camera recording to be used for the purposes of promotional material and publications, and I waive any rights of compensation or ownership thereto. I hereby consent (in accordance with GDPR) for my information to be stored by Tula Vida and to be used for the Tula Vida mailing list.

By signing, I acknowledge that I have read and understood all of the terms of this Release and Assumption and that I am voluntarily giving up substantial legal rights, including the right to sue the Releasee.
