Terms & Conditions, Waivers & Privacy Policy

Thanks for visiting www.tulavida.com. By using this site, interacting, purchasing, downloading, booking or registering through this site, or through a booking agent (including WeTravel.com) you agree to the following terms and conditions with TLV Balanced Life SRL (“Tula Vida”) and its affiliates, and this constitutes a binding legal agreement (this “agreement”). Please read these carefully – if you do not agree with them, please leave the site.

Insurance

I understand I must have medical and travel insurance and by accepting these Terms and Conditions I am affirmatively stating I have necessary coverage.

I understand and acknowledge that I will be around horses and other animals, swimming, taking jungle walks and will be in the jungle and the countryside. I recognize that these activities may require physical exertion that may be strenuous and could cause physical injury, and I am fully aware of the risks and hazards involved.

I understand that it is my responsibility to consult with a physician prior to and regarding my participation and any overseas travel precautions.

Payment

A 50% non-refundable deposit is payable upon registration to reserve my place and no refunds will be offered for cancellations. The balance is due no less than 60 days before the stay, event or experience date. If a different payment schedule is offered by Tula Vida or its agents for my booking, I agree to abide by the stated schedule.

I acknowledge that I may be charged foreign or other transaction fees by a bank or credit card provider or booking agent in connection with this payment, and I agree that I will be responsible for any such charge. I acknowledge that payment may be made through the international banking system or other payment agent and that Tula Vida is not responsible for any delays, unforeseen charges or additional information requested, and I agree to promptly comply with all reasonable requirements.

Cancellation & Refund Policies

All payments are non-refundable and no refunds will be offered for cancellations, nor if I do not attend nor if I leave early. I understand that my travel insurance is the place to seek compensation if I need to cancel or am unable to attend the experience.

Border Closure

In the event that the Costa Rica government closes the borders to tourism, your funds will be transferable to another retreat or experience at Tula Vida.

Photo, Video and other Media

I give permission to Tula Vida and or parties designated by Tula Vida including any and all hosts, facilitators and/or companies to photograph and video me and use such photograph(s) and video(s) in all forms of media, in perpetuity, worldwide, unless I have explicitly expressed otherwise in writing to Tula Vida. I consent to the use of my name in connection with the photograph(s) and video(s). I understand that I will not receive any payment for my time or expenses or any royalty for the publication of photograph(s) or video(s) or the use of my name and I hereby release Tula Vida and/or any parties including any contractors designated by the Company from any such claims. I certify that I have read and fully understand this consent and release and that all questions pertaining to this consent have been answered to my satisfaction.

Risks

In consideration of being permitted to stay and/or participate in the event or experience, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of staying and/or participating, including any travel and any or all activities done at the place, event or experience, or as an individual at the accommodation and facilities provided at Tula Vida in Costa Rica.

I represent and warrant that I am physically fit and I have no medical conditions (including mental health) that would prevent my full participation.

I, the traveler, declare and state that it is my personal decision to travel, and I am doing so with full knowledge of current travel recommendations and travel restrictions with regards to the risks of COVID-19 or other illness. Ultimately it is my responsibility to understand and abide by all requirements and restrictions when traveling.

In further consideration of being permitted to participate, I knowingly, voluntarily and expressly waive any claim I may have against Tula Vida, any and all hosts, facilitators and/or company, and staff for injury or damages that I may sustain as a result of participating in the stay, experience of event. I, my heirs and legal representatives forever release, waive, discharge and covenant not to sue Tula Vida for any injury or death caused by their negligence or other acts.

I have read the above release and waiver of liability and fully understand its contents.

No Substitute

Products, services or experiences offered or described in this site are not substitutes for professional, legal, financial, medical or psychiatric advice or care. Clients are encouraged to please seek the advice of a trained Medical Doctor about any health concerns and of a licenced Mental Health Practitioner for any mental health concerns. All sessions, products, services and content are subject to the client’s interpretation.

Your use of the site and any personal information you provide through it remain covered by the terms listed in this policy, as well as all our terms and conditions.

Information we collect: When you visit www.tulavida.com, we receive some technical information that does not directly identify you and is used to enhance your visit to the site, to help make it more useful to you and to know how many people visit and how they use the site. We do not obtain personal data, such as name or address, unless you choose to give us that information.

ii. Data encryption and security: The security of your data important to us; however no method of transmission over the Internet, or method of electronic storage is 100% secure and while we strive to use commercially acceptable means to protect it, we cannot guarantee, ensure or warrant the security of any information that identifies you personally. Such information is provided at your own risk.

iii. Information you give us: You may choose to give us personal information, for example by completing a form, registering for a newsletter, or conducting transactions online. We use that information for the purpose stated on such form. You (as a user) are responsible for the accuracy of the personal data you provide to us and to communicate any changes.

Personal data collected through the site will be incorporated into automated files owned by us in order to give you the best attention and information. We will not transfer your personal data to third parties (other than to enable us to provide the services requested by you) without your explicit consent.

We use our best efforts to keep your personally identifiable information secure. Only authorized employees, agents and contractors (who have agreed to keep information secure and confidential) have access to this information. However we may use third-party service providers to monitor and analyze the use of our service. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our service. This data is shared with other Google services. In the event that any provision of these terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof)

Prohibited Use

Any use of this site which may disturb the use by other visitors of the internet, which potentially affects the functioning of this site negatively, or which can cause damage to the information provided via this site and/or to the underlying software, is prohibited.
